East Beach Condo, HOA and Public Beach Guide, Gulf Shores
On an East Beach condo or hotel, the first question is who pays and who votes, not how to build a wall. This guide covers the 2023 restoration, the control line and how an association decides.

East Beach runs from Little Lagoon Pass east toward Gulf State Park. The City of Gulf Shores covers the city beach and the Gulf-front lots, and Alabama State Parks manages the park beach and pier. The Census geocoder places 101 E Beach Boulevard here. Condo towers, hotels and public access dominate, with fewer single-family owners than West Beach.

Condo, hotel and public frontage on East Beach
For most East Beach buildings, the limit is the control line on the survey and the vote the declaration requires. For single-family Gulf-front rules west of the pass, see the West Beach guide.
What did the 2023 beach restoration change?
It rebuilt the sand and dunes in front of East Beach. The city announced the project in October 2023 to repair damage from Hurricanes Nate and Sally. Two dredges worked around the clock, placing about 18,500 cubic yards of sand a day. City announcement
Dredging began east of the pass on November 1, 2023. Crews closed about 1,500 feet of beach at a time for around 72 hours. Questions went to city Emergency Management at (251) 968-2425. City announcement
- Dunes were rebuilt to as much as about 12 feet of elevation.
- The plan called for roughly 500,000 plants and more than 3,000 feet of sand fencing.
- Planting was set for late February or early March, after the sand was tilled.

How do the control-line rules hit a tower or hotel?
The same bar applies to a tower as to a house. Nothing new may go between mean high tide and the control line, and the code names a hotel or condominium as a structure. City code 7-122 City code 7-121
A multi-unit project on a control-line parcel owes the state two extra items. ADEM multi-unit rule
- A natural-hazards study with a wave and storm-damage analysis.
- A Beach and Dune Enhancement Plan: a fence along the line during construction, walkovers, sand fences, dune planting and a maintenance program.

How does a condo or HOA board decide on a wall or dune project?
Start with the declaration. Under the Alabama condominium act, the association maintains shared parts unless the declaration shifts that duty. Condo act 35-8A-307
Money follows the same document. Assessments are set at least yearly on an adopted budget, and past-due amounts may accrue interest capped at 18 percent. Upkeep of a limited common element may be billed only to the units tied to it, where the declaration permits. Condo act 35-8A-315
A neighborhood association is different. The homeowners' association act reaches developments with a declaration recorded since January 1, 2016, and it excludes condominiums. HOA act 35-20-3
- Ask the manager for the declaration, budget and reserve schedule. An HOA under the act must provide them within 30 days of a written request. HOA act 35-20-13
- Order an engineer's report on the walkovers, retaining walls and drainage the association maintains.
- Collect written bids and compare scopes, not just totals.
- Hold the vote the declaration requires, with the assessment shown.
The condo seawall repair page and the HOA page cover bids and reserves in more detail.
What happened to the Gulf State Park pier?
Sally destroyed a section of the pier, the public landmark at the east edge of the city beach, in 2020. NHC Sally summary
Repair took a $13.6 million state contract to replace a collapsed section of about 200 feet with concrete pilings. The pier had been renovated for $2.4 million in 2020. ADCNR report
Even a distant storm tests it. Tropical Storm Bertha passed 65 to 75 miles offshore in July 2026, and the pier closed after waves popped up several walking tiles. NWS Bertha report
Why it matters to a board: a public pier on concrete pilings still needed a major rebuild after one hurricane. Budget your own reserves for storm repair.
Can you build on Lake Shelby or the park lakes?
No written path exists for a private wall or dock on a park lake, so ask Alabama State Parks first. The state runs the Lake Shelby picnic area with a boat launch and a kayak launch. Waverunners are barred, and alligators live in the park. State Parks rules
ADEM lists Shelby Lakes as swimming, fish and wildlife water. ADEM classification The city sand rule also reaches Lake Shelby and Lake Shelby Creek. City code 7-122(a)
What habitat and lighting rules apply on a busy beach?
Beach mouse critical habitat includes a 192-acre Gulf State Park unit east of Gulf Shores. Habitat units Part of the park and several named condominium and resort projects are excluded because habitat plans cover them. Habitat exclusions
The city lighting rule reaches from the tide line north to the Highway 182 right-of-way, so tower fixtures count. Zoning 6-12G
How do flood premiums and storm repairs interact?
FEMA's rating system puts Gulf Shores in Class 10, which means no flood premium discount. FEMA CRS list Substantially damaged buildings are treated as new construction under city code. City code 7-30
Plan storm repairs with that threshold in view. See the flood zone guide and the insurance guide.
What could the work cost?
Budget in three layers on East Beach. Fees come first: $14,000 for the newspaper notice on a multi-unit project and the state's $2,545 for a hardened structure. Next come engineering and inspection above $50,000. The wall or dune work depends on the design. Size reserves before asking owners for a special assessment.
These are published prices, not a quote. Local numbers come from Baldwin County public bids and Orange Beach permits. National guides fill the gaps and are labeled as national. Your wall depends on height, access, soil and permits.

East Beach & the public beach project questions
Who pays for dune and wall repairs at a Gulf Shores condo?
The association usually handles shared parts, unless the declaration assigns them elsewhere. Upkeep of a limited common element may be billed just to the units tied to it, where the declaration permits.
Code of Alabama 1975 Sec. 35-8A-307, Upkeep of Condominiums · Code of Alabama 1975 Sec. 35-8A-315, Assessments for Common Expenses
Did the 2023 beach restoration end the need for walls?
No. It rebuilt dunes to about 12 feet and added plantings, but the control-line bar on new structures still applies to the same land.
Beach Restoration Update (posted Oct. 25, 2023) · Art. VII Gulf Front Beaches and Dunes, Sec. 7-122(b), (c), (f)
What extra studies does a hotel or condo project need?
A natural-hazards study with a wave-height and storm-damage analysis, and a dune enhancement plan with sand fences, walkovers and a maintenance program.
Can I build a dock on Lake Shelby?
We found no written private permit path for park lakes. The lake is a public launch area, so ask Alabama State Parks first.
Does the city offer a flood premium discount?
Not now. FEMA's rating system puts the city in Class 10, and that class carries no discount.
