Magnolia Springs and the Magnolia River: piers, boathouses and bulkheads

A Magnolia River pier or bulkhead inside the town needs a town Land Use Certificate before any county permit. The river is also an Outstanding Alabama Water, so runoff draws extra scrutiny.

Magnolia Springs is a small river town of 811 residents in 2020. Below town, the Magnolia River is unincorporated county land, whatever the mailing address says. The river runs through town and empties into Weeks Bay. Mail still arrives by boat, so a pier here can be a mail stop as well.

Magnolia Springs permits, river rules and what to ask Town Hall

Short answer. Inside the town, get the Land Use Certificate first. Then the county issues the building and flood permit, and state and federal agencies review the river work. The town was amending its zoning text in late 2026, so confirm current standards.

Who permits work on the Magnolia River?

Two governments split the job inside town limits.

What about the lower river below town?

The town polygon leaves out the river mouth and Weeks Bay, so the lower river is unincorporated. Census place geometry

No Land Use Certificate applies there. County Planning and Zoning and the Building Department handle those lots. County permit jurisdiction The county parcel viewer settles any doubt. Parcel viewer steps

What do the town's pier, boathouse and bulkhead rules say?

The standards live in zoning ordinance 2010-06. On October 31, 2026, the town home page listed a pending text amendment, with a Planning Commission hearing on November 3, 2026. Town home page, October 2026

Treat the old numbers as unconfirmed. Ask Town Hall at (251) 965-9888:

  • Is a vertical bulkhead allowed outright, or does it need a variance from the Board of Adjustment?
  • How long does Land Use Certificate review take, and what does it cost?
  • How many piers, slips and boathouses may one lot have, and how large can a boathouse be?
  • Does any overlay or historic district rule apply to your parcel?

The state already prefers softer banks. State Lands asks for native wetland plants, riprap or interlocking brick wherever feasible, in place of a vertical seawall. State Lands stabilization rule

What does an Outstanding Alabama Water change?

ADEM rates the river as an Outstanding Alabama Water from Weeks Bay upstream to the 10-foot elevation mark. ADEM water use rule In this Tier 2 class, new point source discharges need proof of no feasible alternative. Nonpoint sources must use best management practices. ADEM OAW rule

On a wall or pier job, expect silt fences, controlled dewatering and care with fill. Walls are not banned. Town volunteers have sampled this water since 2010, and their data helped win the designation. Magnolia River Water Watch

The Weeks Bay reserve core also reaches here. It takes in the bottoms of the Fish and Magnolia rivers up to the mean high tide line. Reserve plan ADEM may refuse uses that alter the reserve's natural character. ADEM reserve rule

What do state and federal agencies add?

  • ADEM's coastal rules reach the low river shore. ADEM coastal area rule Piers and boathouses need pilings that allow reasonably free tidal flow. Boathouses and platforms go at the waterward end, not over wetlands or grassbeds. ADEM pier rules
  • For work below mean high tide, State Lands gives a pier serving one home a Consent of Use if it preempts under 5,000 square feet. Consent of Use scope Docks sit 10 feet inside the riparian lines unless a neighbor signs off in writing. Riparian setback rule
  • The Corps Mobile District reviews the work at (251) 690-2658. Corps Regulatory contact Send a full package with drawings that show mean high tide, coordinates and a narrative. Common rejection reasons

Is a bulkhead the usual shore here?

No. A 2009 state survey found about 15.4 miles of Magnolia River shoreline, of which 12.9 miles were natural. Hard protection, mostly bulkheads, covered 2.5 miles, or about 17 percent. Weeks Bay watershed plan

That is far less than the bay and Fish River, so a new wall stands out. Boathouses line each shore, and the river was once the commercial road for steamers and paddle wheelers. Town history page Compare options in the living shorelines guide and the bulkhead materials guide.

Public bluff repairs show what reviewers see as workable. A federally funded project is restoring four bluffs, over 900 feet in all, plus 3,131 feet of Schoolhouse Branch, using natural channel design. MBNEP project summary The award was $9,003,000. NFWF award

How does the mail boat affect a pier?

A contract carrier based in town runs a 31-mile boat route serving 180 homes. Residents keep mailboxes at the end of their piers. Few places in the country still have year-round boat delivery. USPS Employee News

Keep a mailbox within reach of the boat. Warn the carrier before a long rebuild so mail does not pile up.

How high should the deck and cap sit?

Baldwin County requires a new building's lowest floor one foot over base flood elevation. County freeboard rule The floodplain ordinance sets no bulkhead height, so use water records. County floodplain ordinance

  • The Weeks Bay reserve gauge read 4.3 feet above average high tide in Nate (2017) and 4.2 feet in Zeta (2020). NOAA water level ranking
  • Normal tides are modest, a daily range of 1.6 feet. NOAA gauge history
  • About four feet of water can be carried from the bay into the river. Coast Pilot 5

FEMA's rating table has no entry for the Town of Magnolia Springs, so ask your agent about any flood insurance discount. FEMA CRS table The flood zones guide explains elevation certificates.

The bay and Fish River are in the Weeks Bay, Fish River and Marlow guide. The Baldwin County page covers rules every county lot shares.

What could the work cost?

Public prices here are mostly permit fees, listed in the table. Construction cost depends on the shore type. Ask Town Hall what the Land Use Certificate costs.

These are published prices, not a quote. Local numbers come from Baldwin County public bids and Orange Beach permits. National guides fill the gaps and are labeled as national. Your wall depends on height, access, soil and permits.

How does the Outstanding Alabama Water label affect bulkhead work?

It is a high water-quality class. New discharges are limited, and runoff needs best-practice controls. On a wall job, that means careful silt control and dewatering.
