Weeks Bay, Fish River and Marlow are unincorporated Baldwin County. The county permits structures, and a state reserve holds the water bottoms. Mailing addresses scatter across three ZIP areas, so a street address can mislead. Tides are small, but rain and wind move the water.

Weeks Bay and Fish River: reserve rules, permits and access
Who issues the permit around Weeks Bay and Fish River?
Baldwin County. A Census boundary check places Weeks Bay, Fish River Point, Bayside, Marlow and Barnwell outside every town. Census boundary check

What is the county Marine Accessory permit?
It is the flood permit for piers, docks, boathouses, lifts, bulkheads and seawalls. File it in the CitizenServe portal with the Corps authorization and State Lands notice attached. County Marine Accessory permit
Fill, grading and dredging also draw a land disturbance fee. County planning fees The county checks builders' licenses. County contractor rules The verify a contractor guide shows how to look one up.
What does the reserve own, and does it permit anything?
The reserve does not issue your permit. But its core area includes the water bottoms of Weeks Bay, the Fish and Magnolia rivers and their tributaries. Reserve management plan
- The Weeks Bay National Estuarine Research Reserve, set up in 1986, covers 9,317 acres of forest, marsh and bog. The state conservation department manages it. ADCNR reserve description
- ADEM warns that a use altering the reserve's natural state may not be permissible. ADEM reserve rule
- A NOAA notice of October 20, 2026 invites comment on adding 11 state parcels and more water bottoms to the boundary. Federal notice, October 2026

What does Outstanding National Resource Water change?
Weeks Bay carries the label that the reserve plan calls the highest water quality designation in Alabama. Reserve plan ADEM bars new or expanded point source discharges to it. Tributary discharges, such as Fish River's, must not harm the bay, and runoff must use best management practices. ADEM ONRW rule
For a bulkhead or pier, that means construction controls, not a ban. Expect scrutiny of silt, dewatering and stormwater. Fish River and branches such as Polecat, Cowpen, Turkey and Waterhole are classed for swimming and fish and wildlife. ADEM classification
What pier limits apply on Weeks Bay?
The Corps' general permit for piers sets Weeks Bay limits. Alabama General Permit 05
- Piers run no longer than 300 feet from the shoreline.
- Each site has at most two boat berthing areas.
- Terminal decks, berths and roofs total 620 square feet or less. They may be screened but not walled.
Under ADEM's August 2026 conditions, general permits cannot cover boat slips, dredging or ramps on lots that front Weeks Bay. Those projects need an individual review. ADEM coastal conditions
Walkways over marsh or grass beds must be uncovered, no more than 5 feet wide, and grated or spaced to pass light. General permit design rules The docks and boat lifts page covers the basics.
How much of the shore is already hardened?
Not most of it. The watershed plan, using 2009 survey data, found about 26 percent of Weeks Bay shore and about 24 percent of Fish River in hard protection, mainly bulkheads. Weeks Bay watershed plan
- The reserve plan says turning natural buffer into bulkheaded shore erodes its value for water quality and fisheries. Reserve plan language
- A federal project, recommended at $3,541,936, removes a degraded bulkhead at the East Gateway tract and restores marsh as a training site. NOAA project listing
- The watershed plan sketches five living shorelines of about 200 feet each in each of three tidal areas. Watershed plan proposal

How do tides, rain and storms behave here?
Tides are small. NOAA lists a 0.5-meter range for the reserve. NOAA reserve page The old Weeks Bay gauge, removed in April 2022, logged a daily range of 1.6 feet. NOAA gauge history
Fish River's lower reach moves 1 to 1.5 feet a day, and its level shifts fast after rain. ADCNR Fish River profile Schedule barge work around forecasts.

What should a buyer know about a Fish River bluff?
In Kidd v. Benson, a stabilized Fish River bluff collapsed months after a sale. It took part of the bulkhead and a boathouse. The sellers won at the state's highest court, because the buyers accepted the house as is and never inspected it. Alabama Supreme Court, 2020 Inspect before you close, and see the buying a waterfront home page.
The Magnolia River enters along the eastern shore and has its own guide. To the east, see the Bon Secour guide. Countywide rules are on the Baldwin County page.
What could the work cost?
The permit table lists the public fees. Build prices depend on shore length, bay depth and barge access. Shallow water can limit equipment, so ask each bidder how heavy gear will reach the site.
These are published prices, not a quote. Local numbers come from Baldwin County public bids and Orange Beach permits. National guides fill the gaps and are labeled as national. Your wall depends on height, access, soil and permits.
