Is a dock and boat lift permit separate from the seawall?

No. A dock or lift is reviewed like a bulkhead: the Corps, State Lands, ADEM and the city or county all weigh in. A wall repair and a dock repair can share one plan.

  • A dock that rests on the wall can pull on it. Check both.
  • State Lands allows a simpler Consent of Use for marginal docks and mooring pilings along an existing seawall or bulkhead. State Lands rule 220-4-.09
  • A boat lift adds load on pilings and sometimes new pilings, which can trigger review.

See bulkhead replacement, seawall inspection and the bulkhead permit guide.

What do State Lands and ADEM require for a dock?

Alabama owns the bottoms below mean high tide. State Lands issues a Consent of Use or an easement for a dock built over them. State Lands rule 220-4-.09

  • A Consent of Use covers a dock or boathouse serving one single-family parcel, or two adjacent ones, if it preempts under 5,000 square feet. State Lands rule 220-4-.09
  • The application is a Request to Impact State Owned Submerged Lands with a $100 fee. State Lands application fee
  • A dock should stay 10 feet or more within your riparian lines (the extended side lot lines), except for shared and bulkhead docks. State Lands rule 220-4-.09
  • Your dock may take up no more than a quarter of the waterway breadth, and it needs a 100-foot buffer from a federal channel. State Lands rule 220-4-.09
  • The ADEM fee for a single-family dock on pilings is $800. ADEM fee schedule

Does a dock fit the Corps general permit?

Many private docks fit the Corps general permit for piers, ALGP-05, in force from October 1, 2026 to September 30, 2031. 2026 Alabama general permits

  • The general permit caps the terminal platform at 3,000 square feet and the berths at three, and the pier may span at most a quarter of the waterway. ALGP-05 limits
  • Keep 100 feet clear of a federally maintained channel unless the Corps waives it, which matters on the Intracoastal Waterway.
  • Walkways over wetlands or grassbeds must be 5 feet wide at most and grated. ALGP-05 design rules
  • ADEM bars ALGP-05 for piers on parcels fronting the Gulf. Those need individual review. ADEM coastal conditions
