Fort Morgan Gulf side: beach house seawall, dune and permit rules
A new seawall on a Fort Morgan beach house lot is rarely allowed. Start with your survey, because it shows the Coastal Construction Line, and a federal beach mouse permit often sets the schedule.

Gulf-front lots on the Fort Morgan Peninsula lie west of the Gulf Shores city line, in unincorporated Baldwin County. The county runs the beach and dune permit under state rules. The Alabama beach mouse, an endangered dune animal, adds a federal permit that often takes longer. Kiva Dunes, The Dunes and The Beach Club have their own older habitat plans.

Who permits Gulf-front work on Fort Morgan?
Baldwin County does. Gulf Highlands, Cedar Grove, Palmetto Beach and Fort Morgan fall outside the Gulf Shores city polygon and outside any other town. Census boundary check
The county Coastal Area Program reviews any lot the Coastal Construction Line (CCL) crosses, plus every lot on its beach side. You apply in the CitizenServe portal as a "Coastal Area Program Permit." Baldwin County Coastal Area Program
The county acts for the state. ADEM says Baldwin County runs permits and enforcement under its Division 8 beach and dune rule. ADEM delegation notice
Where is the Coastal Construction Line?
On Baldwin County's Gulf shore, the CCL runs parallel to the water, 40 feet inland of the most inland point of the dune crest. ADEM rule definition Your surveyor plots it from state plane coordinates and the nearest CCL monument. ADEM Division 8 permit rule
Between mean high tide (the average high-tide line) and the CCL, new structures and substantial improvements are barred. So is removing primary dune sand or vegetation. ADEM no-build zone
- A wall on the beach or a primary dune must sit landward of the CCL. It must defend a structure that already stands or was permitted earlier. It also needs proof that no workable non-structural option exists. ADEM Gulf armoring limit
- ADEM expects you to rule out dune restoration, beach nourishment and retreat first. ADEM alternatives list
- A repair or upgrade costing half a structure's value or more is a substantial improvement. ADEM definition
The Gulf-front armoring guide covers the statewide rules.
What does the beach mouse permit require?
Federal critical habitat for the beach mouse covers about 1,211 acres in Baldwin County. The Fort Morgan unit is 446 acres, mostly south of Fort Morgan Parkway. The Gulf Highlands unit adds 275 acres. Federal critical habitat rule
Before a building permit, the U.S. Fish and Wildlife Service recommends an incidental take permit for any lot with habitat. The application carries a $100 processing fee. USFWS beach mouse guidance
Most lots use the peninsula's General Conservation Plan instead of writing their own. Its main limits:
| Topic | What the plan says |
|---|---|
Eligible lots | Zoned R1 or R2; R4 and R6 only if built at that density |
New home footprint | 0.1 acre including driveway and parking |
Additions and pools | 0.05 acre more, lot total capped at 0.1 acre |
Storm rebuild | Covered for two years if the footprint is identical |
In-lieu fee | $2.30 for every square foot of impact |
Exterior lights | Amber LED, 9 watts or less, shielded |
Cats and trash | No free-roaming cats; rodent-proof containers |
Sources: GCP eligibility GCP footprint limits GCP in-lieu fee GCP lighting and cats
The fee adds up. An August 2026 federal notice listed about $14,700 for a 0.147-acre home and about $1,000 for a pool deck. Federal Register notice, August 2026
Which lots are under their own plans?
The 2007 critical habitat rule left out areas that already had habitat plans. These are The Dunes, Bay to Breakers, Kiva Dunes, Plantation Palms, The Beach Club, and Beach Club West and Gulf Highlands. 2007 exclusions
Their plans carry their own lighting and landscaping terms. Get your association's plan before you hire anyone.
Repairs inside an existing home's footprint can often proceed without a take permit. A new pool, a wider driveway or new planting is different, and the Daphne office asks to hear first. USFWS repair guidance
When can a dune walkover be built?
Only outside sea turtle nesting season. Baldwin County bars walkover construction from May 1 through November 1. County walkover standards
- One walkover per parcel, 4 feet wide for a single-family or two-family lot.
- It ends 10 feet seaward of the dune vegetation line.
- No lighting of any kind.
- Nothing taller than 38 inches above the walking surface.
- ADEM and the Fish and Wildlife Service approve length and location.
Enrolled Gulf-front lots also need an elevated wooden walkover. Set it at least one foot above the highest dune or six feet above grade. In nesting season, move beach gear 100 feet landward of the high-tide line each evening. GCP beach equipment rules
How long does the whole process take?
Plan on months, with the federal permit first. The county step takes about six to eight weeks and includes a 30-day public notice. County Coastal Area Program timing
The county checklist asks for the take permit up front. It also wants a sealed survey and a wetland line if wetlands are present. County checklist Older batch plans left some owners waiting two to four years, so start the federal talks early. USFWS plan history
What do storms and flood rules add?
The peninsula has taken hard hits. Georges in 1998 produced an 11.9-foot surge at Fort Morgan, the highest Alabama value that storm recorded. NHC Georges report Danny in 1997 put 6 feet of salt water inside Fort Morgan. NWS Mobile Danny report
In the coastal high-hazard zone, the county bars man-made alteration of sand dunes. New foundations must stand on piles or columns. Solid walls below one foot above base flood elevation are not allowed. County V-zone rules
A new home's lowest floor must sit a foot or more above base flood elevation. County freeboard rule The flood zones guide explains the maps. The storms guide covers repair after a hurricane.
What about public land beside your lot?
Much of the nearby beach is now public or conservation land. The state bought 192 acres with 2,700 feet of Gulf-front beach at Gulf Highlands and Beach Club West. That stopped a permitted condominium. Gulf Highlands acquisition
Bon Secour National Wildlife Refuge trails close at sunset, and pets are not allowed. Refuge rules Survey your line before you clear, fence or build a walkover beside refuge land. The refuge office, at (251) 540-7720, takes boundary questions. Refuge contact
East of the peninsula, where the city permits Gulf-front work, see the West Beach guide. The peninsula's bay shore has a different permit path, in the Fort Morgan bay side guide.
What could the work cost?
The county coastal permit for a single home was $1,110 on the 2014 schedule. The beach mouse in-lieu fee is $2.30 per square foot of impact. A qualified marine contractor or engineer can price the physical work once your survey shows the line, the dune and the habitat.
These are published prices, not a quote. Local numbers come from Baldwin County public bids and Orange Beach permits. National guides fill the gaps and are labeled as national. Your wall depends on height, access, soil and permits.

Fort Morgan Gulf side project questions
Is a new seawall allowed on the Gulf side of Fort Morgan?
Seldom. A wall on the beach or a primary dune must sit landward of the Coastal Construction Line and defend a structure already there. Retreat and similar options must be ruled out first.
ADEM Admin. Code Chapter 335-8-2, rule 335-8-2-.08 Construction and Other Activities on Gulf Front Beaches and Dunes · ADEM Admin. Code r. 335-8-2-.06 Shoreline Stabilization and Erosion Mitigation
Do I need a beach mouse permit to repair my house?
Often not, if the repair stays inside the original footprint. A pool, a bigger footprint or a new driveway changes that. Call the Daphne office before you plan it.

How long does the county coastal permit take?
The county quotes six to eight weeks, and the 30-day public notice is part of that. The federal take permit is usually the longer step, so start it first.
